Nebraska federal court decision striking state marriage amendment has implications for Minnesota

Tom Prichard, President of the Minnesota Family Council (MFC), criticized a Nebraska Federal District Court decision striking down Nebraska’s state constitutional provision defining marriage as between one man and one woman will be felt in Minnesota and across the country.

“The federal courts have now entered the battle over marriage and illustrates the growing threat to marriage laws and state constitutional amendments posed by activist judges. The Nebraska decision reinforces the urgent need to pass not only the Minnesota Marriage Amendment but also the Federal Marriage Amendment,” said Prichard.

On Thursday, May 10th, a federal district judge in Nebraska struck down Nebraska’s marriage amendment saying it violates the 14th amendment equal protection clause and that Nebraska had no rational interest in promoting unions between opposite sex persons. The marriage amendment struck down passed with 70% of Nebraska voter’s supporting it.

“The Minnesota state legislature must act quickly and pass the Minnesota Marriage Amendment to protect marriage from activist state judges. But also Congress needs to act to protect marriage with a federal marriage amendment,” added Prichard.

“The filibustering of judges, who understand their role is interpreting the law not legislating from the bench, must stop. This is merely another illustration of the urgent need to stop the stonewalling of conservative judges,” concluded Prichard.
